Terms of Use for MomTick
1. Scope
These Terms of Use apply to the use of the mobile application "MomTick" (hereinafter the "App"), provided by:

By downloading or using the App, you accept these Terms of Use.
2. Purpose of the App — important notice
MomTick serves exclusively for your own documentation of contractions (start time, duration, interval). The App records the data you enter yourself by tapping and presents it clearly.
MomTick is not a substitute for medical advice, diagnosis or treatment. The App gives no recommendations for action, no medical assessments and no warnings. Every decision about how to proceed — in particular when to contact a midwife, a doctor or a hospital — is yours to make on your own responsibility or in consultation with medical professionals.
If you have health concerns, are uncertain, or in an emergency, contact a midwife, a doctor, your hospital or the emergency services without delay (in Germany: 112).
3. Requirements for use
A compatible smartphone is required (iOS/Android in accordance with the minimum requirements stated in the stores). The App works entirely offline; a permanent internet connection is not required.
4. Purchase and licence
The App is made available through third-party platforms such as the Apple App Store and Google Play. The conditions for using the App are governed by those platforms. Payment processing and refunds are handled exclusively by the third-party platforms such as Apple and Google in accordance with their respective terms; we have no influence over them.
With a purchase you receive a simple, non-transferable right to use the App for private purposes on your own devices. Passing on, reproducing or commercially exploiting the App beyond the mechanisms customary in the stores is not permitted.
5. Disclaimer of liability
The App is developed to the best of our knowledge, but without warranty of constant availability, freedom from errors, or the accuracy of the values you record and that are displayed (for example in the case of incorrect operation, timing inaccuracies of the device, or technical faults).
We accept no liability for damage arising from the use or non-use of the App, in particular not for health consequences attributable to reliance on the data recorded or displayed in the App. The App is purely a documentation tool, not a medical device and not medical device software.
Liability for intent and gross negligence, as well as liability under the German Product Liability Act, remains unaffected.
6. Availability and changes to the App
We endeavour to keep the App functional but give no guarantee of uninterrupted availability. We reserve the right to change, extend or discontinue functions of the App in the course of updates.
7. Intellectual property
All rights in the App (software, design, the name "MomTick", logo) belong to us or the respective rights holders. These Terms of Use grant you no right to use these elements outside the intended use of the App.
8. Changes to these Terms of Use
We reserve the right to adapt these Terms of Use where necessary, for example if the scope of functions of the App changes. The version published in the App or on the associated website at the time of your use shall apply in each case.
9. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions of your country of residence prevent this.
10. Severability clause
Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.
